Pet Sitting Terms and Conditions for Dogs
You are kindly requested to read our Terms and Conditions of Business. As with any contract, they tend to dwell on the more negative side and can often be scary reading. Please be assured that we will look after your dog with the same care and attention that we look after our own dogs. Definitions
In these conditions unless the
context otherwise requires:
'Canine Care Company' means Marie
Kemp and any persons working under that name at her request.
'The
Owner' means the individual who has authorised Canine Care Company
to take care of their dog(s) and for whom Canine Care Company has
agreed to do so.
'The Home Boarding Booking Confirmation Form' means the
particulars form so headed.
'The website' means Canine Care
Company website at www.Dog-Minder.co.uk
Conditions Applicable
These conditions shall
apply to the contract between Canine Care Company and the Dog Owner to
the exclusion of all other terms and conditions.
Charges and Payment
The home boarding charge shall
be an amount set by Canine Care Company and agreed (either verbally
or in writing) by the Owner.
In addition Canine Care Company
shall be entitled to charge the Owner:
Any special charges
authorised in advance.
Any vetirinary charges incurred by Canine
Care Company for the benefit of the Owner's dog.
The full
replacement value of any property (whether belonging to a Canine
Care Company or to any third party) damaged by the Owner's dog
including (but not limited to) damage by defecation or chewing to
any carpet or furnishing.
Any charges relating to the above shall
be payable by the Owner on collection of their dog, unless otherwise
agreed by Canine Care Company.
Deposit
Most of the time Canine Care Company will ask for a deposit of at
least 50% of the total cost, and payment must be made at the time of
booking to reserve a place for your dog.
Cancellation Fees
If you were to cancel 28 days (or
less) prior to the booking start date Canine Care Company would
charge 50% of the total booking cost, which would usually be the whole of
the deposit.
Owner's Undertaking
The
Owner hereby agrees and undertakes with and warrants to Canine Care
Company:
That he has full power to enter into this agreement
without the consent of any third party.
That his dog has not been
exposed to rabies or distemper within the period of 30 days prior to
this agreement and has been inoculated against canine parvovirus,
canine distemper, canine adenovirus/infectious canine hepatitis,
leptospirosis and other relevant diseases and such inoculations
remain effective at the date of this agreement. The
Owner will provide the dog’s vaccinations certificate with Canine Care
Company for the period of boarding, in line with the The Animal
Welfare (Licensing of Activities Involving Animals) (England)
Regulations 2018. All primary vaccinations must have been given at
least two weeks prior to boarding.
That his dog is clean, with de-flea and
anti-worm treatments.
That his dog has not been in any other
boarding kennel establishment within the two weeks prior to dog boarding.
That his dog has not at any time prior to the date hereof attacked
any human being or animal.
That there are no material facts or
circumstances, which have not been disclosed to Canine Care Company
and which, if disclosed, might reasonably be expected to affect the
decision of Canine Care Company to enter into this agreement
That
the information set out in the Home Boarding Booking Form is complete and correct in every respect.
That Canine
Care Company may engage the services of a veterinary surgeon of its
choice and authorise such veterinary surgeon to undertake such
treatment as may in the joint opinion of Canine Care Company and the
veterinary surgeon be required to treat the Owner's dog.
That he
will indemnify Canine Care Company and its servants and agents
against all costs, claims and damages arising (directly or
indirectly) from any act of the Owner's dog whilst in Canine Care
Company's care.
That he will collect his dog promptly at the end
of it’s agreed boarding period and at that time pay any outstanding
charge.
Any breach by the owner of the
undertakings/warranties contained in this agreement shall entitle
Canine Care Company to place the Owner's dog in dog boarding kennels at
the Owner's expense, and if necessary, without giving notice to the
Owner.
Whilst every dog shall be with us
continually and outside in the garden with us for a large part of
the day, weather permitting. However, in line with The Animal
Welfare (Licensing of Activities Involving Animals) (England)
Regulations 2018
Canine Care Company's Undertaking
Canine Care Company hereby undertakes with the Owner to take
reasonable care of the Owner's dog during the period of its boarding
in Canine Care Company's premises.
Canine Care Company is insured in accordance with the terms of their insurance policy. Canine Care Company will not accept any liability for loss, injury or death to the Owner's dog unless (and only to the extent that) such loss, injury or death is recoverable under the terms of the insurance policy.
Owner's Failure to Collect
In the event of
failure by the Owner to collect his dog from Canine Care Company on
the due date, Canine Care Company reserves the right to terminate
this agreement without notice and to re-home the Owner's dog by any
reasonable means.
This agreement contains a whole agreement
between the parties. It is subject to English Law and any dispute
arising out of it shall be subject to the jurisdiction of the courts
of England and Wales.
